SGI stated in the claimant's injury notes ... "All in all I did not okay any homecare ... Also the fact that she has not received homecare in the past, I did not want to open a can of worms. I’ll leave this to you Darlene to look after.”

In the AIAC decision it stated, "For more than 13 years, the Appellant’s requests for home assistance were largely ignored or denied without written reasons."

Tips For an Injury Claim

The Government of Saskatchewan does nothing ...
This website is to promote positive change with the No-Fault law in Saskatchewan
(I  am just using my situation as an example of it's faults.)
(There is a lot of repetition on this page that I still have to remove. Sorry)

There are still multiple problems with SGI and the auto insurance system in Saskatchewan.
I got a letter from many Saskatchewan politicians (Brad Wall and Ken Cheveldayoff) stating he can not interfere in anyone's specific case with SGI.  That is correct.  But the Government of Saskatchewan still HAS responsibilities because they chose to have a monopoly run their auto insurance as opposed to having a free market auto system in Saskatchewan.

If there were more claimants who never received their benefits over the years, could there be a class action lawsuit brought against SGI and/or the Government of Saskatchewan? (In the future, if the Government of Saskatchewan implemented a random check on claimants to ensure they got their benefits from SGI, this would essentially eliminate any of the government's culpability in the future if someone did not get a benefit for an extended amount of time)

Are there more people who didn't get their benefits for long periods of time from SGI from the same adjuster?
Or was there a bigger problem with the system that the Government never looked at?!?
(Since writing up this website, I have found  at least 4 or 5 more people who have NOT gotten their benefits) -- Saskatchewan has a very big problem that needs to be addressed!

(That being said, there was a reassessment done on the No-Fault system in 2015. But when I read the reassessment, I thought there could be more improvements made that would not cost the public, tax payers or SGI anything.  Plus, they never addressed whether or not claimants were getting all their benefits from SGI and how to ensure that they are getting all their benefits in their claim. More is talked about in the eBook and in the tab "Change")

If there was a free market system in Saskatchewan over the auto insurance and other auto insurance companies were allowed in the province, the Government of Saskatchewan would not have to do anything.
The free market would prevail and everything would be figured out through the free market.  The specific insurance company would figure out what went wrong and take appropriate steps to ensure this never happened again.  Part of a company's business plan has to involve some reliability in getting insurance for their customers when they need otherwise they will lose customers.

But with a monopoly, the company does not have to figure out what went wrong because they have 100% of the customer base. SGI and the politicians just have to shoot, shovel and shut up to fix the problem .... which is exactly what they did!!!!

The government chose to go with a monopoly to govern their auto insurance in Saskatchewan.  A monopoly IS NOT a free market system.  If you don't believe me, listen to Milton Freeman, an economist who won a Nobel Peace Prize in the the 70s.  He is the expert on a free market society.  And he is quite funny; he has a lot of dry wit. I love this guy!!!

Since Saskatchewan does not have a free market system for auto insurance and and there is NO check or balance on the auto system, the Government needs to ensure that this did not happen to anyone else since the beginning of the No-Fault system.  It also needs to ensure there are policies and procedures in place so this does not happen in the future, as well.

If this was just a claimant who had a problem with SGI's assessment of a benefit, got a decision letter, went to court, the Government of Saskatchewan would not have to do anything.  This happens everyday with SGI.  But this is not.  This is an extreme case where a claimant did not receive a benefit that she needed for 13 years, and never got a decision letter. The Government of Saskatchewan needs to find out what went wrong otherwise they need to go to a free market system.

The Government of Saskatchewan needs to have an independent party act as a single entity without SGIs or the Government's interference to check to see if this happen to anyone else.   Was it an adjuster who went rogue and did this to other claimants as well or was this done in a certain area of claims, or were benefits not given to claimants who had severe brain injuries?  Or were benefits held back to claimant's families who had businesses because it was thought they could afford the extra expense?  They need to understand why this happen so they can prevent this from happening in the future.

If the government does not want to check to make sure this is an isolated event, then they NEED to go to a free market.
They could have a big mess to deal with later if there are more people who find out they did not get all their benefits later. A lawsuit could be extended to the Government of Saskatchewan.

If the Government of Saskatchewan does not want to find out if this is an isolated case, then Saskatchewan NEEDS to go to a free market system for auto insurance.  Even if Saskatchewan had a duopoly for auto insurance in Saskatchewan, then the Government may not have to get involved as this would be more of a free market system. And people would choose which insurance company they wanted based on rates, compliance with laws, and other aspects. (I would advise caution with going to a duopoly because even though it may reduces certain issues, it may cause even bigger problems down the road; but I am not an expert)

The Government of Saskatchewan has done nothing.
Yes, they did a reassessment of the No-Fault system in 2015 to change a few laws, but that does not deal with anything to ensure that people have received all their benefits they needed over the years.
If I went to appeal my decision, the outcome would still be the same.

And because the government has done nothing to change the No-Fault System or how SGI operates, there could be another claimant in the future who does not get one of their benefits for over 13 years.

If you had ever had an injury claim especially if you had a brain injury since the beginning of the No-Fault legislation in 1995, I would phone SGI to talk to your adjuster's supervisor to see if you got all the benefits especially if your claim center was the same as mine. The government did not check to make sure this was an isolated case.  SGI will state you did receive your benefits, but please be cautious.  You really need to have evidence.

Please note ....

1,2. I got the information about the history of the No-Fault system for this website from the legal document, 'Cash and Crash' written by Kenneth Noble and Reginald Watson. I try my best to put this problem into my own words based on my experience. But when I did quote them verbatim, I gave credit to the article.  Most of the information in this website is BASED on my own experience while using their document to confirm my information. Quoting them when I could.

I do not have copyright over the information on this website. But I will maintain copyright over my story.  (which probably means nothing by just saying it)  Please copy as much as you want and create a new website with this information.

I also talk about penalizing SGI monetarily if they do something wrong and using the money for a judge.  I actually thought of a better way to use that money but can not remember at this time. Sorry

I will be attaching all the evidence that I talk about on this website, including emails, changes of adjusters and voice messages.  But it will take some time to do this.

If the system is not dramatically changed, you may want to get rid of the AIAC in Saskatchewan.

My latin is not so good.  So  I mixed up the words Ex Gratia and Ex Parte on this website and ebook.  It will take me a while of rechecking it to fix it.

And my grammar, punctuation, and editing are terrible as I am in a time crunch so please do not be too judgemental.  I have a lot of dangling and squinting modifiers and split sentences. Use this as information for a claim not as a chance to critique someone’s writing.

Please read Cash and Crash by Kenneth Noble and Reginald Watson.  I think you can get it from the Law Society of Saskatchewan Library.  This will help you understand the system surrounding Auto Claims in Saskatchewan. I would like to see them on the Gormley Show.
If I forgot to mention Reginald Watson as one of the writers as Cash and Crash, I am sorry. I initially thought it was only written by one lawyer.
